The Non-Paying Tenant Process in Maryland
If a tenant under a lease stops paying rent, Maryland's failure-to-pay-rent process applies under Real Property §8-401. As the Maryland People's Law Library describes it: you give written notice that the tenant has 10 days to pay; if they do not, you file a complaint in the District Court; the court issues a summons and holds a trial; and if you win, you file a warrant of restitution so the sheriff can oversee the eviction. A tenant can often 'pay to stay' up until the sheriff acts, which can reset your progress.
The Holdover Tenant Process
If a tenant's lease has ended but they will not leave, that is a 'tenant holding over' situation — a separate action from both failure-to-pay and wrongful detainer. You give the required notice and file the appropriate holdover complaint in District Court. The key point: a holdover tenant is not a squatter, so you cannot use the faster squatter process on them. Using the wrong action gets your case dismissed and restarts the clock.
You Still Cannot Self-Evict
No matter how far behind the tenant is or how badly the unit has been treated, you cannot change the locks, remove belongings, or shut off utilities to force them out. Only the sheriff, on a court order, may remove a tenant. This is the rule that turns a bad tenant into a months-long, expensive ordeal — and it is the reason many landlords decide they simply want out.
